General Provisions of RFQ Process

The Supplier who participates in RFQ process of PT Asuransi Jiwa Generali Indonesia shall adhere to all the requirements of this RFQ, including any amendments in writing by Generali.

1. Confidentiality

This RFQ document and its attachments have been prepared by PT Asuransi Jiwa Generali Indonesia contains information (some classified as Confidential) regarding PT Asuransi Jiwa Generali Indonesia, the Generali group companies and its joint ventures around the world.

The Supplier be obligated to take all reasonable precautions and measures to protect and safeguard all information in this document from any unauthorized access, use, copying, disclosure, damage or destruction.

The Supplier undertakes to ensure that its Representatives (i.e. respective officers, directors, partners, members, employees, agents, consultants, advisors, attorneys, subcontractors and accountants) abide to use and manage the information in this document solely for the purpose of this RFQ.

The Supplier shall be fully accountable for any form of consequences, include lawsuits, regulatory punishment and financial obligations, for any information breach conducted by its Representatives. The Supplier shall indemnify PT Asuransi Jiwa Generali Indonesia for any loss and hereby releasing Generali from any claims and/or lawsuits that may arise in the future.

2. Intellectual Property

All material, content, layout and design contained in this document is the exclusive property of PT Asuransi Jiwa Generali Indonesia. No express or implied right of use is hereby granted to any party whatsoever who gains access to this information. Third-party product and company names mentioned herein are the trademarks of their respective owners.

3. Ethical Code

PT Asuransi Jiwa Generali Indonesia is committed to performing its business by complying with the current legislation, professional and ethical practices and requires the Supplier to observe the highest standard of ethics during the procurement process and contract implementation.

4. Conflict of Interests

Relations between PT Asuransi Jiwa Generali Indonesia and the Suppliers are governed by objective criteria. Under no circumstances shall the personal relations or interests of employees influence the award of a contract or an order.

No employee, directly or indirectly, can draw any personal benefit from the award of a procurement contract. Consequently, any benefit or present given or received that may be intended as a tool influencing the independent judgment or conduct of the parties involved shall be forbidden.

If the Supplier discovers a potential risk of conflict of interest due to a personal relationship between certain personnel of PT Asuransi Jiwa Generali Indonesia and the Supplier, or vice versa, the Supplier is obliged to disclose that relationship to PT Asuransi Jiwa Generali Indonesia as soon as possible after receiving this RFQ document.

5. Fraud, Bribery and Corruption

PT Asuransi Jiwa Generali Indonesia strictly enforces a zero-tolerance on proscribed practices, including fraud, bribery, corruption and collusion.

The Supplier shall guarantee that its representatives will not provide any refunds, commissions, prizes, wreaths, parcels, or mementoes of any kind either directly or indirectly to PT Asuransi Jiwa Generali Indonesia’ employees.

6. Anti-money Laundering, Anti-terrorist Financing and International Sanctions

PT Asuransi Jiwa Generali Indonesia is also committed to the international fight against money laundering and the financing of terrorism, opposing any conduct that could be intended as supportive of these crimes.

Necessary measures will be taken if any indication of an attempt on illegal purposes, such as money laundering or terrorist financing, is found in our Supplier.

7. Workers protection

The Supplier shall operate in strict compliance with all national and international applicable rules and regulations, including the Fundamental ILO Conventions, the UN Universal Declaration of Human Rights, and the rules and standards of the relevant business sectors.

In particular, The Suppliers shall acknowledge the rights of their employees and treat them with dignity and respect. They shall be committed to:

  1. not using nor tolerating the use of child, forced, obliged or undeclared labour;
  2. not implementing nor tolerate any form of discrimination based on nationality, gender, racial and ethnic origins, religious beliefs, political opinions, age, sexuality, disability or health in recruitment and remuneration policies, access to training, career development, dismissal or staff retirement;
  3. granting the staff the right to set up and join trade union organisations of their own choice and to hold collective negotiations with the company in line with the rules, practices and cultures of the various countries;
  4. ensuring a safe and healthy working environment and adopting suitable measures to prevent any accident or damage to workers’ health;
  5. complying with the laws and standards applicable in the relevant business sector on working hours and public holidays;
  6. respecting the staff’s right to decent remuneration;
  7. providing suitable staff training.

8. Environmental protection

PT Asuransi Jiwa Generali Indonesia also requires its suppliers to promote environmental safeguard by minimising the impact of their business through efficient use of natural resources, preference to renewable energy, correct waste disposal and greenhouse gases reduction.

9. Applicable Law and Regulations

All related documents, procedures and all stages in this RFQ process is subject to the applicable laws and regulations of the Republic of Indonesia and therefore shall be conducted, created, governed and construed under the laws of the Republic of Indonesia.

The information and opinions contained in this document have been compiled from or arrived at in good faith from sources believed to be accurate and reliable at the time of its release. In preparing the Proposal, the Supplier is expected to examine the RFQ in detail. Material deficiencies in providing the information requested in the RFQ may result in the rejection of the Proposal.  Therefore, the supplier is fully responsible for obtaining clarifications on the scope and requirements of the RFQ, and must not take advantage in any way of missing or incorrect information in the present document.

If the Supplier found any uncertainty, inaccuracy, ambiguity, and contradictory information within this RFQ document, the Supplier should seek clarification prior the submission date.
